Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the Terms, then you do not have permission to access the Service.
We use your personal information for providing and improving the Service. By using the Service, you agree to the collection and use of information in accordance with our Privacy Policy. Unless otherwise defined in our Privacy Policy, terms used in that policy have the same meanings as in these Terms and Conditions, accessible at https://examrize.com.
By creating an account on our Service, you agree to receive newsletters, marketing or promotional materials, and other information we may send. You may opt out of receiving any, or all, of these communications by following the unsubscribe link or instructions in any email we send.
If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase, including without limitation your card number, expiration date, billing address, and shipping information.
You represent and warrant that: (i) you have the legal right to use any payment method(s) submitted in connection with a Purchase, and (ii) the information you supply to us is true, correct, and complete.
The Service may use third-party services to facilitate payment and completion of Purchases. By submitting your information, you grant us the right to provide it to these third parties, subject to our Privacy Policy.
We reserve the right to refuse or cancel your order at any time for reasons including, without limitation: product or service availability, errors in the description or price of a product or service, error in your order, or suspected fraud or unauthorized or illegal transactions.
We are constantly updating our course and service offerings. We may experience delays in updating information on the Service and in our advertising elsewhere. Information found on the Service may contain errors or inaccuracies and may not be complete or current, and we cannot guarantee the accuracy or completeness of any information on the Service.
We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.
Any contests, sweepstakes, or other promotions (collectively, "Promotions") made available through the Service may be governed by rules separate from these Terms. If you participate in a Promotion, please review its applicable rules as well as our Privacy Policy. Where Promotion rules conflict with these Terms, the Promotion rules will apply.
Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring, periodic basis ("Billing Cycle"), set either monthly or annually depending on the subscription plan you select.
At the end of each Billing Cycle, your Subscription will automatically renew under the same conditions unless you cancel it or ExamRize cancels it. You may cancel your Subscription renewal through your account management page or by contacting our customer support team.
A valid payment method is required to process your Subscription. You must provide accurate and complete billing information, including full name, address, and payment details. By submitting such information, you authorize us to charge all Subscription fees to that payment method.
Should automatic billing fail for any reason, ExamRize will issue an electronic invoice indicating that you must manually settle the corresponding amount by a specified deadline.
ExamRize, in its sole discretion and at any time, may modify Subscription fees. Any fee change becomes effective at the end of the then-current Billing Cycle. We will provide reasonable prior notice of any fee change so you have the opportunity to terminate your Subscription before it takes effect.
Your continued use of the Service after a fee change takes effect constitutes your agreement to pay the modified amount.
Except where required by law, paid Subscription fees are non-refundable.
Our Service may allow you to post, link, store, share, or otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content you post, including its legality, reliability, and appropriateness.
By posting Content, you represent and warrant that: (i) the Content is yours, or you have the right to use it and to grant us the license described in these Terms, and (ii) posting it does not violate the privacy, publicity, copyright, contract, or other rights of any person or entity. We reserve the right to terminate the account of anyone found infringing a copyright.
You retain all rights to Content you submit and remain responsible for protecting those rights. We assume no liability for Content posted by you or any third party. By posting Content, you grant us the right and license to use, modify, publicly display, reproduce, and distribute it on and through the Service, and to make it available to other users subject to these Terms.
ExamRize has the right, but not the obligation, to monitor and edit Content provided by users. Content found on the Service (excluding user Content) is the property of ExamRize or used with permission, and may not be distributed, modified, reused, or repurposed for commercial gain without our express written permission.
When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide is accurate, complete, and current. Inaccurate, incomplete, or outdated information may result in immediate termination of your account.
You are responsible for maintaining the confidentiality of your account and password, and for any activity that occurs under your account. You must notify us immediately of any breach of security or unauthorized use of your account.
You may not use as a username the name of another person or entity, a name subject to another's rights without authorization, or a name that is offensive, vulgar, or obscene. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion.
The Service and its original content (excluding user-provided Content), features, and functionality are and will remain the exclusive property of ExamRize and its licensors. The Service is protected by copyright, trademark, and other applicable laws of India and other jurisdictions. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
We do not allow the use of ExamRize pages, resources, or assets, or the uploading or linking of related images, videos, or files, on websites of the following nature: pornographic, racist, hateful, defamatory or libelous, extremely violent or promoting violence or terrorism, promoting self-harm, related to narcotics or controlled substances, or otherwise deceptive, misleading, fraudulent, or illegal.
Accounts that breach this Acceptable Use Policy will be terminated immediately and without negotiation.
Our Service may contain links to third-party websites or services that are not owned or controlled by ExamRize. We assume no responsibility for the content, privacy policies, or practices of any third-party sites or services, and we do not warrant the offerings of those entities. You acknowledge that ExamRize is not responsible or liable for any damage or loss caused by or in connection with your use of, or reliance on, such third-party content, goods, or services. We strongly advise reviewing the terms and privacy policies of any third-party site you visit.
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, at our sole discretion, for any reason, including a breach of these Terms.
If you wish to terminate your account, you may simply discontinue using the Service. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
You agree to defend, indemnify, and hold harmless ExamRize and its licensees, licensors, employees, contractors, agents, officers, and directors from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney's fees) arising from: (a) your use of and access to the Service; (b) a breach of these Terms; or (c) Content posted on the Service.
In no event shall ExamRize, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to, use of, or inability to use the Service, or any conduct or content of any third party on the Service, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damage.
Your use of the Service is at your sole risk. The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
ExamRize, its subsidiaries, affiliates, and licensors do not warrant that the Service will function uninterrupted, secure, or available at any particular time; that errors or defects will be corrected; that the Service is free of viruses or other harmful components; or that the results of using the Service will meet your requirements.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages, so some of the limitations above may not apply to you.
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision is held invalid or unenforceable, the remaining provisions will remain in effect. These Terms constitute the entire agreement between us regarding the Service and supersede any prior agreements.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice before the new terms take effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree, you are no longer authorized to use the Service.
